CAREER

Yiduo is Partner of employment team in Hengdu Law Firm in China. She supports multinational clients on all types of legal matters that involve their employees, including employment contracts, remuneration, layoffs, discrimination, employee IP infringements and termination of senior employees.

She has been focusing on Employment & Labor practice for more than 12 years. Yiduo has extensive experience in litigation and arbitration, handling complex employment-related issues, and advising a number of prestigious multinational companies. She has experience in handling contentious matters, such as disputes arising out of employment termination, work-related injury, infringement of company trade secret, violation of non-compete obligations, employees transfer, etc. Recently, Yiduo has advised science and technology companies on termination of employees and implementation of employee compensation and incentive schemes in various jurisdictions.

She is a member of Social Law Studies Institute of China Law Society and a member of Beijing Labor and Social Security Law Studies Institute. She is participating in project of drafting China’s Labor Standard Law.

Yiduo graduated from China University of Political Science and Law with an LLB and Northwestern University with an LLM.

Before joining Hengdu, she worked for King and Wood Mallesons and DLA Piper. Her languages are Mandarin and English.

EXPERIENCE

·    Advising on the redundancy program in which the client laid off 65% of all employees due to economic decline, guiding the client through the entire process of the project, drafting tailored redundancy documents to all its employees including but not limited to mutual termination agreement, suspension notice, departure certificate, severance calculation table, etc..

·    Advising to a U.S. based company in reducing employees in China. Providing strategies and assistance through the entire process of the headcount reduction process.

·    Acting as long-term legal counsel for luxury companies, Fortune 500 enterprises in energy area, famous capital investment companies, Fortune 500 enterprises in machinery manufacturing area, well-known pharmaceutical companies and many other State-owned institutions, listed companies and foreign-invested enterprises.

·    Advising a multinational company on confidentiality and IP agreement and the non-competition and non-solicitation agreement globally.

·    Advising a famous advising company on international secondment and independent contractor issues.

·    Advising on a RMB 1.980 million arbitration case against a foreign employee who required high amount of reimbursement.

·    Advising a multinational financial services company on new policies regarding anti-discrimination and sexual harassment.

·    Representing one of the largest pharmaceutical companies in the first instance trial regarding an employee’s unilateral termination.

·    Representing one of the Fortune 500 enterprises in labor arbitration and litigation with eight former senior management employees (including CEO and CFO), who were dismissed due to misconduct of forging fraudulent financial documents and revenue and allocating false costs on a long-term and large-scale basis.

·    Providing training for a foreign chamber of commerce on how multinational employees respond to discrimination, bullying and sexual harassment in the workplace.
